These Terms & Conditions (“T&C”) govern your use of Fulfillio’s services, including warehousing, logistics, storage, distribution, and transport (“Services”), as well as your access to our website www.fulfillio.com.au (“Website”). By engaging our services, visiting our website, or otherwise interacting with us, you agree to these T&C.

“Fulfillio”, “we”, “our”, or “us” refers to Master Import and Management Pty Ltd ACN 656 721 407 as trustee of the Nest Import and Management Trust trading as Fulfillio.

“Customer” or “you” agree to any person or entity engaging Fulfillio’s services.

If you do not agree with any of these terms, do not use our services or website.

2. Acceptance of Terms

By using Fulfillio services or accessing our Website, you acknowledge and agree to be bound by these T&C.

• We will follow your storage instructions where possible.
• Goods are stored at your risk
• Special handling requirements must be provided in writing.

5. Payment and Fees

• You agree to pay all fees, charges, and invoices in accordance with the agreed payment schedule.
• We may suspend or terminate services for overdue payments.
• Taxes, duties, and customs charges are your responsibility unless otherwise agreed.

6. Liability and Insurance

• To the extent permitted by law and subject to these T&C, all warranties, conditions and other terms express or implied by statute, custom or common law are excluded.
• Nothing contained in these T & C excludes or restricts any consumer guarantee, warranty, condition, right or remedy implied by any statute (including the Australian Consumer Law) which cannot be excluded, provided that, to the extent that the statute permits, Fulfillio is entitled to limit its liability for a breach of a guarantee, condition or a warranty implied by that statute and where permitted by law we limit our liability to the declared value of the goods.
• We strongly recommend you arrange adequate insurance coverage for your shipments.

This indemnity is a continuing obligation, independent from the other obligations under these T&C and continues after these T&C end.

We are not responsible for any loss, damage or expense, howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent suffered by you or any third party, arising from or in connection with your use of our website and/or the content and/or any inaccessibility of, interruption to or outage of our website and/or any loss or corruption of data and/or the fact that the content is incorrect, incomplete or out-of-date.

If any provision of these T & C is found invalid or unenforceable, the remaining provisions will continue in full force.

These T&C together with 3PL Services Agreement constitute the entire agreement between you and Fulfillio regarding the Services.

Neither party is liable for failure to perform obligations due to events beyond their reasonable control (force majeure).
